John Edwards

A North Carolina judge is considering whether a former aide to John Edwards should be held in contempt in the legal fight over a purported sex tape involving the ex-U.S. senator and presidential candidate.

Superior Court Judge Michael R. Morgan signed an order Thursday finding probable cause for criminal contempt charges against Andrew Young and his wife, Cheri Young. A hearing is scheduled for Nov. 7.

The judge says the Youngs and their lawyers may have violated a protective order by giving federal prosecutors confidential records from a lawsuit filed by Rielle Hunter, Edward’s former mistress. She claims the videotape is her property.

The Youngs’ attorney said Friday they were ordered by a federal judge to hand over the materials from the state civil case to prosecutors pursuing campaign finance charges against Edwards.
